Participant Waiver & Release of Liability (Full Text)

By registering for any class, membership, event, workshop, or activity offered by Desi Dance Fitness LLC (“DDF”), and by checking the required agreement box on the registration form, I acknowledge and agree as follows:

1. Voluntary Participation & Assumption of Risk

• I understand that dance and fitness activities are inherently physical and may involve vigorous movement, stretching, lifting, and use of props or equipment.
• I am aware of and voluntarily assume all risks of injury, illness, or property damage, including but not limited to slips, trips, falls, muscle strain, sprains, fractures, heat-related illness, and exposure to communicable diseases such as COVID-19.

2. Medical Fitness

• I certify that I (or my child) am physically able to participate and have no medical condition that would prevent safe participation.
• I accept full responsibility for consulting with a physician if needed and for all medical expenses arising from participation.

3. Release of Liability

• I, on behalf of myself, my heirs, and my minor child (if applicable), hereby waive, release, and forever discharge Desi Dance Fitness LLC, its owners, instructors, employees, independent contractors, volunteers, and any landlords, studio owners, or operators of facilities where classes or events are held, from any and all claims or demands for injuries, damages, losses, or expenses arising out of participation—whether caused by negligence or otherwise, to the fullest extent permitted by law.

4. Property & Personal Belongings

• I understand that DDF and any rented studio space are not responsible for loss, theft, or damage to personal property, including clothing, electronics, or valuables, whether stored in cubbies, lockers, vehicles, or elsewhere.

5. Emergency Care Authorization

• In the event of injury or illness, I consent to receive (or for my child to receive) emergency medical treatment and accept responsibility for all related costs.

6. Communicable Diseases (Including COVID-19)

• I acknowledge that participation may expose me to contagious diseases. I voluntarily assume all related risks and release DDF and studio owners from liability for exposure, illness, or related consequences.

7. Media Release

• I grant DDF permission to use photos, audio, or video taken during classes or events for promotional, educational, or marketing purposes, in any medium now known or developed in the future, without compensation.
• I decline media release (if offered as an opt-out box).

8. Minors

• If I am signing on behalf of a minor, I represent that I am the child’s parent or legal guardian and have full authority to sign this waiver and to release all claims on their behalf.

9. Binding Agreement

• I understand that checking the required agreement box during registration acts as my electronic signature and creates a legally binding contract enforceable under applicable law.
• This waiver remains in effect for all future participation until revoked in writing.

I have carefully read and fully understand this waiver and release of liability. By checking the agreement box, I voluntarily consent to these terms on behalf of myself and/or my minor child.
